Your second point totally misplaces the burden of proof. The burden of proof is on FGators. Now, how does one go about proving riggedness? You'd need to show that the deviation from expected is non-negligible over a significant sample. Even if FGators lost with AA aipf every single time he had them, the sum total of every hand FGators plays isn't even a significant sample in terms of how many hands PokerStars deals in a given day. So there is no case at all, because how can there be?

To get to trial, he would have only have to convince a judge that there was some likely hood a reasonable jury could rule in his favor. Once you have two statisticians arguing with each other, it's an argument of who is more credible, which means it goes to trial.
