I agree with op about rights being violated because of a similar incident over the 4th of July.

Minnesota has tons of lakes and I was partying it up in a town called Detroit Lakes. Anyway, was planning on staying with a friend but he didn't realize how many relatives were at his cabin so after I had been drinking a few hours he told me I probably couldn't stay. I stopped drinking and go the next 2.5 to 3 hours without drinking & chugging water while looking for other options in case I didn't think I could drive yet. Never found anyplace else to stay so i drove home, about 45 miles away. The road home goes through a bunch of little towns. I stop in one about 6 miles from home because I had to crap. Left the store and went a few miles. While at a light I realized I kinda had to crap again and didn't and didn't wanna risk trying to make it home again. I knew there was a gas station on my right so I pulled in but it was closed. Did a U-turn around the gas pumps and left going the way I originally was. Get pulled over by a cop who was apparently staking me out. Asks why I went into 2 gas stations within a couple miles. I say diarrhea. Have to take the field breathalyzer and fail. While this is going down, I ask why I got pulled over. He says "suspicious vehicle". No swerving, no traffic citations. Complete and total b.s.

Innocent til Proven Guilty? I lost my license in MN until we get through with court.

Weird: I actually was on a no carb diet too and although I was tired from being in the sun all day felt under the legal .08 limit. I hadn't had a drink for at least 2.5 hours. I have done some research into this and found out that these diets increase the acetone levels and can screw with breathalyzer readings because of this.

Oh, I did an English paper on whether or not Minnesota should lower their BAC to .08 right around the time it was to be enacted. I can't remember the exact figures but something like 96% of all alcohol related accidents involve someone with a BAC of .14 or greater. It's total B.S. to lower the law unless we are starting to attack the social drinkers. This does nothing to help the situation. Lowering it IS MADD's way of trying to instill prohibition on alcohol in America.
