The FBI website states it considers online poker illegal but to my best knowledge does not enforce it. There are prosecution issues because the actual servers are not in the US. So the courts could find that you are actually playing in Costa Rica( or where ever the servers are) and exempt from prosecution. I'll try and find the FBI link ,its in this forum somewhere.
