Ya, I wouldn't be surprised if they would prosecute..Just because your activity is questionable doesn't mean stealing from that should be. A game was robbed at gunpoint (shots fired) in my hometown a couple years ago. Luckily I took that night off, anyway, the cops were called and they had no problem prosecuting the thieves and no charges were ever brought against anyone involved in the game, and if I remember correctly the money was even returned. I know its apples and oranges, but still....
