I view this from a different angle: It establishes the right of private citizens to enjoy bars and other public buildings unmolested by the foul air that results from smoking.

I don't know many bars that are public buildings. Should be up to the business owner whether they allow smoking or not, and it's your choice whether to enter or not.

Yes, I misused "public building". However, people that don't smoke should be able to go out and play pool or watch a ball game on TV or simply enjoy socializing with others, without having to encounter rooms full of cigarette smoke. As such, the right to clean air supercedes the rights of the property owner. You can not, simply because you own property, disregard public health and/or the health of your patrons. Should a restraunt owner be able to decide whether or not his employees wash their hands after using the restroom? It is, also, similar to the land owner that prefers to have an outdoor toilet (non-plumbed out house), or the person may like to burn their trash in thier back yard. Both are prohibited in most places for public health reasons, and because they infringe on the rights of others that can choose whether or not to enter those properties.
