I believe they are counting it as a forfeit loss to Kramnik as even Kramnik appears to have given up trying to get that game replayed. He has made some threats about suing FIDE etc, but the result for the purposes of this match appears to be set.

Further, the line as posted would make no sense otherwise - if Kramnik was truly 1 game ahead, the line would be something like +manyhundred on Topalov I would guess.
