Nothing, as yet - however, both IR and suspension may supercede the clause in the CBA about 35-year-olds, etc., etc. I think it's a very gray area - if I were New Jersey, I'd pay Malakhov $500K under the table to stay home in Russia if that would get him off the cap - he doesn't want to come over and live in Lowell for 7 months. Same thing with IR - teams could just IR players who they didn't want to have on the cap. It's rumored the Devils are seeking a second opinion on Mogilny to be sure he is not fit to play.
