To the OP.

If you want any chance of seeing your daughter in the long run. Stop acting like an idiot. Can you imagine what her lawyer will say when it comes to the custody case?

Lawyer: "So why did you move out of the house and demand access to your daughter?"

You: "She (points to ex) had an afair."

Lawyer: "How do you know she had an affair?"

You: "Well she had a phone call on my cell phone that lasted maybe ten seconds, and wouldn't tell me who it was."

Lawyer: "Did you ever speak to the other person?"

you: "No."

Lawyer: "Did you ever see the person you claim she was having an affair with?"

you: "No."

Lawyer: "Do you have any proof that she had an affair?"

You: "She had a phone call!"

Lawyer: "That's a no then."

Lawyer: "So someone phoned her? What happened next?"

You: "I shouted at her and tried to kick the bedroom door in."

Lawyer: "So, your ex had a crank phone call, whereupon you imediately shouted at her while your daughter slept in the next room. When your ex feared for her safety she ran to the bedroom, and again with your daughter in the next room you tried to kick the door in."

You: "Um, yeah."

Lawyer: "She (ex) says she had a crank call, and you flew off the handle and tried to attack her. When did you stop beating your wife?"

You really think you have a chance? Grow up and grow some balls. Talk to her, sort it out. You're in a bad situation and acting dumb won't help.
