Actually, Daniel says in his video blog, right before he starts sharing his opinion to the viewers that he is NOT a lawyer and this is just his opinion.
He also wrote (I believe) in a forum post at FCP that he had talked to Andy Bloch about this issue, to what extent he didn't say.
