Preflop is an "it depends". Usually I'd fold, but you can 3-bet iso a player like this in a number of conditions. Among them I'd think would be if he tends to fold easily to aggression with more marginal hands (he almost always has 2 overcards so if he folds the flop on a lot of misses you will show a nice profit) or if he plays very predictably postflop (ie you can get in extra value bets when ahead, avoid folding when your hand is good, and avoid spewing bets when he does pair up as much as possible). Also you want the blinds to not to be very loose.
He's probably not check/folding an underpair, the board is nasty for one, but he's probably going to at least bet/fold, your range has a fair amount of non-A/non-K underpairs. Usually when people cap they're leading, the check is more apt to mean a monster IMO (although given the steal-y nature of this, he could just be capping light and playing strangely).
I still cap the turn, 6 combos of AA/KK vs. 9 of AK (er, is that right? that seems funny) and he could well play AQ or something like this sometimes. Fine to cool it on the river too.
