Do you think i can sue my isp over this?
I just want someone else point of view.
I was playing High Stakes PL Omaha (with most of my online bankroll on the table, about 12 grand) Im playing 100/200$ blinds 5 handed. Okay heres my story, someone raise preflop 600$, 2 callers now it's my turn to act, so i decided just to call with A[img]/images/graemlins/club.gif[/img]A[img]/images/graemlins/spade.gif[/img]10[img]/images/graemlins/spade.gif[/img]9[img]/images/graemlins/club.gif[/img], the flop comes A[img]/images/graemlins/diamond.gif[/img] 6[img]/images/graemlins/heart.gif[/img] 9[img]/images/graemlins/spade.gif[/img] someone bets 1,200$, the two other guys fold, now it's my turn, i re raise 3,600$ he takes about 10 or 15 seconds then call me, turn J[img]/images/graemlins/club.gif[/img] and suddenly my internet connection disconnect (for no reason at all, by the way i've got a DSL connection, to make things clear) So in a panic moment i try to reconnect as fast and i can, and i get this, "Error 691: The username or the password can't be located on the network" Now i want to break everything i've got in the room because i can't reconnect and basically im screwed, so i call the ISP instantly (god knows i wasn't in a good mood) and they let me know that they suspended my account by mistake, they were trying to suspend someone else on the network but they ended up suspending me by error!!! So basically i lost 4,200$ (instead of doubling up my bankroll) over this *$#*(@ stupid internet provider mistake (on top of that i have the logs & screenshots of everything) What you guys/girls think? |

I used to do support for a cable internet company. One day, someone called with connection problems and said he was about to start an MTT for a few hundred dollars. The residential service was "for entertainment purposes only" and so we wouldn't compensate him for the money he lost. I suspect you'll find the same with your ISP.

if the hand never saw a river then you don't even know if you would have won.
He could have had a lower set that caught quads on the river or he could have had a straight-draw. Any 5 7 8 T Q or K on the river could have made a straight for his 6678 hand or AKQT something. |

In that example, it's a coin-flip for his bankroll. When the OP says "So basically i lost 4,200$ (instead of doubling up my bankroll)", he seems to be under the impression that he was 100% guaranteed to win the hand and double his bankroll.

[/ QUOTE ] Im from Canada. [/ QUOTE ] You initiate a lawsuit in Canada, if you lose, you pay THEIR attorney fees as well (unlike in the U.S.). Also, your ISP contract probably had a clause against liabilities from disruption of service. |

why ask us? Check the terms and conditions you agreed to when you signed up with the ISP. Typically there will be a clause stating that the ISP will refund without quibble any equity you lose due to being disconnected in a hand of online poker. Just bring that to the attention of their customer service manager, and you won't need to sue. In fact the cheque is probably already in the mail.

Why are you asking people on here? You know they are just gonna laugh at you and make fun of you.
The correct thing to do since you are located in Canada is to take legal action against your ISP. First though you need to have some sort of documention of the robbery/loss that happen. I would suggest contacting your local authorities and have them come to your house, take photos of the scene of the crime, and possibly dust for prints for evidence. Once they have done this and you have the correct police reports filed next seek out an attorney who specializes in ISP robberies and disconnection protection or lack of. Once you get to this point it is smooth sailing. Pay any retainer that is necessary and sue your ISP. At worst cause you should at least recover like tree fiddy or more! |

I had an account on here in the past, don't think because i made a new one that i didn't expect anyone to make fun of me, i know how the internet works guys, i just wanted someone else point of view like i said, and by the way no i can't say for sure that i would have won the hand, but id rather lose 12 grand because someone outdraw me than losing the money due to a stupid ISP mistake.

They will refund the time you were disconnected, or the value of one day perhaps, a couple of bucks. They provide you with a service, and you can be refunded for the lack thereof. What you are doing online, poker, stockmarket, online auction, etc. is irrelevent.
As for the poker---I don't play that high, but a friend of mine who does has a laptop on standby through a different connection. He leaves the site up with the login info ready to go for just such occasions. |

Easily worth the cost especially if you're playing this high. |

You can't sue them. Well you can but you'll lose. Every ISP has a clause in their TOS that states something to this effect "We are not responsible for any consequential damages, acts of god, or anything of the like regardless if this causes the user financial harm"

(1) find a good ISP - if it doesn't work (2) find a better ISP - if it doesn't work (3) find a second ISP and have a back-up of your line (O) find a better ISP with a guaranteed service. I'm in the point 2 and I lose from $1 to $10 per month on average because of random failure (past experience). It's somewhat acceptable and since they solve the problems fast ... for now I have no reason to change. In case they change there are always other ISPs. You can ask them. In case you choose (O)ption you can sue them for what ever you have in the agreement. You can have there that they'll pay you $1.000.000 if the line is dropped-off for 2 seconds and you don't have to prove any loss then. But your "I lost because I use [censored] IPS and I want to sue them for being bad is a real joke". Take an agreement with fines in it and you are safe next time.
