Do I owe rent to my landlord?
 
I generally get along with the guy really well, I've lived with him in his house for the last 4 months paying $400 a month to rent out a room.

He's always had problems paying his mortgage, he got in way over his head with the loan. The other day he tells me he is quitting his 2nd job.

Using my logical skills I deduce that it would be impossible for him to make his mortgage payment if he quits his 2nd job therefore he is going to stop making the payment and let the house foreclose. I asked him about this and he hinted that that's what's going to happen. He's already lost 2 of his other investment properties to foreclosure.

It generally takes no less than 6 months for the banks to seize the house, 3 months for the foreclosure and 3 months to evict. So obv he plans on just living here rent free until he gets booted out and I plan on taking the free ride along with him.

So my question is, if he isn't making the mortgage payment, do I still have to pay him monthly rent? Doesn't seem fair.

Ask him straight up. He sounds like a douchebag so he's probably going to want your rent money.

Yes, the fact that he has a mortgage has no relation to your rent agreement. If he owned the house outright and wasn't paying monthly do you think you still wouldn't owe him rent?

Yes, you still owe it.

What he does with his money is none of your business. If there is some kind of contract involved then you might have some action once he tries to kick you out, but you cant start skipping your rent b/c he his skipping his house payment.

Quit being a tool and trying to get free rent.

What do you mean it doesn't seem fair? His credit's gonna be ruined for a long long time. I can't even believe how much of a dirtbag you are for saying it doesn't seem fair.

Sad thing is a lot of people are going through this because of the market.

Of course you owe the rent. Talk about kicking a guy when he's down. He will have to face the consequences to his credit and lose the money he has already put into the house. You really face no consequences except having to find a new place to live.

Of course you don't owe him rent, why the [censored] should you pay rent when he's gonna foreclose on the house. Since his credit is ruined anyway, its not like an extra 400 a month is gonna help his dumass anyway. Right?

Do you have a written lease? If not (and even if so), you should agree with him that you'll start paying your rent at the end of every month or on a weekly basis. As it stands, there's a good chance you'll get evicted in the middle of a month and you'll be out for whatever part of the month you've already paid for.

will he somehow violate your lease agreement by doing what he's doing? i.e., you'll ultimately be kicked out too, and if you have knowledge this is going to happen, maybe you've got an out / excuse to renegotiate your rent..

For the time being he's living up to his part of the agreement with you. Of course you owe him rent. How can this even be a question?

Or are you asking about what you can get away with?

You owe him rent up until the date of foreclosure.

I have been dealing with pre-foreclosure and foreclosure properties lately. When I find tenants living in a house on the day of foreclosure, I instruct them to stop paying rent immediately.

Up until then though, keep paying.

It would be in his moral rights to screw you over by changing the locks and keeping your belongings hostage. Of course you can sue. But after several months of missing your belongings, winning a judgement, you will not collect a penny because you can't get blood from a stone.... You will spends thousands of dollars in legal bills....which would be poetic justice for your conspiracy to steal free housing from him. Your computer will be the first thing he holds hostage from you....

If he welches on his deal with the bank, that is his business. HE WILL *PAY* the price by losing his equity in his home as well as hurting his credit rating. If you welch on your deal then you are attempting to steal frre housing from him... If your goal was to make yourself look poorly on the 2+2 forum.....then you succeeded.

If I ever meet you in person I will keep one hand on my wallet at all times lest you try to rip me off as well....

If you signed a lease w/ him and he is going to break that lease I would say no, otherwise you owe him for any time you stay there. But just talk to him about it, seems pretty easy to me.

1) What lease includes a clause for if they foreclose on his home?

2)What do you mean talk to him? "So hey, should I still pay you rent?"...."Yes."

3)Why did he quit his second job if he knew that it would lead to foreclosure?

You sound like one of those people that has a distant cousin win the lottery and demand that he give you a percentage. He won free money, why shouldn't he have to share! This guy is screwing himself royally by having the bank foreclose on his houses. He took a shot at real estate and like many, he went busto, now you think he owes you free rent? Wow.

His arangement with the bank is between him and the bank, and has nothing to do with you. You have agreed to pay him in exchange for your room, so as long as he provides a room, you are obligated to pay rent. What happens between him and the bank is none of your buisness.

Of course, if you want to be just as much of a douche as him, you could stop paying rent, and live there rent free untill you are evicted, but that wouldn't be any better than what he is doing.

Yes you owe him rent. I don't see how him not paying his mortgage means you don't have to pay your rent.

you owe him rent, unless...

there was some kind of contract signed that you would be living there and paying rent for a year or some amount of time that will now be cut short.

Or if there was just a verbal agreement that you would be living there and paying rent for awhile, and now his decision to quit his job is going to cause you to have to go through the process of packing up and finding a new place to live. If this is the case i would talk to the guy and maybe compromise and pay 1/2 rent or whatever from here on out.

but yea its most likely you owe him some rent

one has 0 to do with the other. of course you owe him rent. what he does on his end is not your bidness. there's other expenses beside the mortgage. he could ding your credit and your ability to rent in the future. pay da man.
