You have a one night stand with a girl you barely know and the condom breaks. She promises that she is going to take a morning after pill. You leave it at that and don't see or think about her for another eight months until she gets back in touch with you and says that she needs to know your name and details for the hospital papers because she is having your baby!

What is your course of action? What responsibility do you have towards the child?

isn't it pretty easy to know who the father is based on the due date? i guess if she banged more than one guy that weekend she wouldnt know, but assume that you are the father for the sake of discussion. obviously a paternity test is standard in this situation.

Also, for the sake of this argument are we supposed to be assuming that she can't figure out our name on her own ie talking to your landlord? It would be pretty hard for a situation to arise where she couldn't track down your name if she was able to find you 8 months later.

I guess the better option is to try and convince her to give it up for adoption.

i think my point was more of along lines that 50% of the genetic material that created that child is yours. yet legally speaking, you have absolutely no say regarding that embyro/fetus/child/living thing until it is born (virtually). once its born, its basically you go from 0% say to about ~20% unless you can establish in court that the mother is a heroin addict.

in addition to ~20% voting rights, you probably are going to get stuck with 50%+ of the fiscal responsibility if you do the 'stand-up' thing.

This is why you should never have a one-night stand without a legally signed document given certain expected actions to ensure no conception and clearing you of all paternal obligations if those conditions aren't met.

It'll cost you a few hundred bucks to get this drawn up from any worthwhile attorney, and you can just make copies of it to keep in the nightstand.
