Won a trip to vegas. They say I can\'t go...
 
So i won a trip for 2 to vegas with full accomadations through the. For some reason, they now say they cannot send me because I am 18 years old even when there is not stipulation of this in their T&C. The pit boss told me, in the T&C

Sorry number 10 Players at the casino must be over the legal age of majority, meaning that the player must be an adult with full contractual capacity or a "major" as that term is legally defined in the country in which the player is resident.

I told him he was an idiot. I'm in Canada it's legal and they never had a problem with it before when I was giving them tons of rake. So now they are offering me a full $1000 to shut me up. Do I take it? Ask for more? Demand they send me? Or rally something on 2+2?

The tickets were for 2 person round trip flights in first class. Staying at like the bellagio for a week. having a 1:25 chance of winning 50k with the 25 other people who qualified for this. Taking you out for dinner, drinks, casino every night and then most expenses. So all this for $1000 comepnsation when they are completely in the wrong. Discuss.

Nevada state law forbids hotels with casinos to let people under 21 years old to put rooms in their names. If you're not 21, and/or not traveling with someone 21+, you can't get a room in a hotel that has a casino on site.

I'd be with my 23 year old brother. But, if this were the case why should I be screwed over and not the website, they didn't say anything about this and obviously the tournament came across as open to everyone, which it was.

If it says nowhere on their site that you must be 21, and it's legal to gamble at 18 in Canada, then I don't think you can let them get away with this.

If you were in violation of their terms, I doubt they'd even offer you the $1K.

I'd do everything I can to get the trip, but I wouldn't want to completely piss them off in the process. I think you should reason with them and offer to post about it on the public message boards, and they will probably give in.

Now that you've already done it, however, they may feel like they have less to lose.

Maybe if you pointed them to this thread and offered to delete it upon confirmation that you'll get the trip..

I've taken the sites name out of the post. I am not trying to soil their name, it wouldn't be fair over something to trivial. I am just trying to find out what my options are as they have laid out very few for me.

Go through their T+C and ram it up their ass if you arent in violation and they dont pay you.

The room needs to be in someones name. Someone needs to check in, be a registered guest and be liable for any expenses added to the room's bill

It doesn't matter how the hotel gets paid (guest, third party like a poker site, or even if the hotel comps it), the room can not be registered to someone under 21.

Also, since you're under 21 you couldn't compete in the tourney they were sending to you Vegas to play. You can't gamble in Vegas if your under 21.

Why would you enter to win a trip to vegas when you know vegas is +21 to drink and gamble and you are not 21? It seems to me that you assume the risk of getting screwed by entering whatever it was, knowing that you could not collect on the prize being offered.

I assumed there was a lot I could still do there and I was under the impression that I would bring my older brother who could do all those things. Also, I considered just giving it to a brother and a friend but the site said they would not allow me to do that. It's not illegal to go to Las Vegas if your under 21.

The point is, the OP did nothing to violate the casino's terms.

It can be agreed on that the room will be booked in his brother's name, and that obviously he won't be able to compete in a tournament (I didn't see any indication that there was a tournament to win the 50K anyway).

With that agreed on, a week in the bellagio with comped meals and first class round trip airfare is better than $1K any day, even without the drinking and gambling.

I'd contact them and let them know that you're not going to just accept this.

Let them know that you believe this to be theft and that you'll post and or get assistance from the watchdog sites if necessary, but I'd word it more creatively.

Your 23-year-old brother didn't win. You did. The room would be in your name, not his. Otherwise, you'd be transferring the prize, which apparently you're not allowed to do.

Also, the purpose of the trip is to compete in a tournament, which you would also not be allowed to do, and neither would your brother. The travel expenses are incidental to the main prize, which is the tournament entry.

Since you didn't post the site, it's impossible for us to know what the T&C says, but I'd be surprised if they completely skipped over the age requirement. That's rather fundamental.

Without knowing all the details, the $1K may or may not be a good deal. In any event, you should have carefully read the T&C and asked questions before entering if there was any doubt.

I didn't conflict with anything in the T&C he tried to make it seem like I did, by saying i violated the thing I posted in bold. But that didn't make any sense. The site realized they were at fault and offered the 1k assuming I would just take it, since then they have moved that offer to 1.5k. What should I be looking for?
The tournament is in a private hall, not in a casino.

All casinos are considered private property in Vegas. So even if the tournament was in the middle of the casino floor, technically, it is in a private hall. The law in regards to 21+ to play remains.

That's what I was thinking. I don't think an offshore casino would obtain or even be able to obtain a license to operate a tournament if it wasn't just for "fun"

No, it is really a trick. They just want you to come on American soil so they can arrest you for violations of the Wire Act. You will be held in Gitmo until you are needed to be shown as Exhibit A of the evils of underage gambling.

Later the CIA will fly you out to an undisclosed Egyptian location to be tortured and killed, then they will fly your body to Moldovia where it will be dumped.

I can not imagine a site going through the trouble of putting on a tourney (and flying people out to it) that was played "just for fun." That make no sense. Who would even bother playing in a "just for fun" tourney in Vegas? It's not like money games are hard to come by in Vegas.

The site would not need a gambling license. Any poker room is Vegas would be willing to host/run a private tourney...for the right price. I've played in a few of these (private tournies hosted by a casino) myself.

I've read tons of legal boilerplate, and I've never heard the term "major" used as the opposite of "minor." Maybe it is, but I've never seen it.

There's also a difference between being of an age to have full contractual capacity in the player's home country, and being old enough to gamble, drink, or as one poster noted, sign for a hotel room in a Nevada hotel that has a casino.

Again, until you post the name of the site so we can look at the T&C, you'll never get an accurate answer.

But assuming you are absolutely correct, and their T&C mentions nothing about age, then yes, you might be able squeeze more than $1K out of them. Good luck with that.

In the T&C it says Number 10:(like number 10 on the list)
Here is the specific thing from the T&C
Players at the casino (referring to online fortune lounge casino, not a casino in Vegas) must be over the legal age of majority, meaning that the player must be an adult with full contractual capacity or a "major" as that term is legally defined in the country in which the player is resident.
I discussed this with him a few days before when he invited me to the tournament where the prize was the trip, which I won. He said it is legal to play at 18 if it's legal in my country. In canada, you can gamble at 18 (can't go to casinos because alcohol is served there). He said it was fine for me to participate in the promotion as I am legally able to gamble over the internet in my country.

The trip just says trip to las vegas. Doesn't say anything about a casino or bars. So it's reasonable to think that I could go their without being 21. They said I could go, but in going it would compromise the integrity of their site. Or that it would promote underage gambling. So I think this is entirely their fault and if they want to cover their own asses it shouldn't be at my expense.

You didn't see language about it in their T&C's but you could have used some common-sense and known ahead of time that there might be a conflict here.

You could simply have asked them before participating in the promo if under 21 was okay to just win the trip to Vegas and you would have saved yourself a big headache.
You had to know that something like this COULD have happened, right?

You could simply have asked them before participating in the promo if under 21 was okay to just win the trip to Vegas and you would have saved yourself a big headache.

The VIP manager informed me via msn that I had qualified for the tournament (which I won). I told him beforehand that I was 18 so I didn't know how much I could do there. He said, "you could still have a really good time." He didn't say anything about age conflict. Also, when a large portion of the site is under 21 they should know a conflict like this could arise and take the necessary precautions to avoid something like this.

Okay, if they told you ahead of time that they would let you go and have a really good time then I believe you have a legitimate gripe.

Perhaps just try to milk more cash out of them for this situation.
