engagement over who gets the ring?
 

a guy and a girl are engaged for 8 months as part of a 4 1/2 year relationship.

the guy cheats on the girl and it appears that the relationship will no longer continue due the the wishes of the girl, the guy wants to work things out.

from a non legal standpoint, is the girl entitled to keep the ring if the guy wants it back or should she return it to the guy?

I don't really know anything about this other than what I've seen in movies. I think she's supposed to throw it down the sewer grate and run off crying. The next man she meets will be wonderful.

On a more serious note, there's a lot of info on wikipedia including:

Tradition generally holds that if the betrothal fails because the man pursues other women or himself breaks off the engagement, the woman is not obliged to return the ring. Legally, this condition can be subject to either a modified or a strict fault rule. Under the former, the fiancé can demand the return of the ring unless he breaks the engagement. Under the latter, the fiancé is entitled to the return unless their actions caused the breakup of the relationship, the same as the traditional approach. However, a no-fault rule is being advanced in some jurisdictions, under which the fiancé is always entitled to the return of the ring. The ring only becomes the property of the woman when marriage occurs. An unconditional gift approach is another possibility, wherein the ring is always treated as a gift, to be kept by the fiancée whether or not the relationship progresses to marriage. [1]

my ex didn't cheat on me but when it ended I just told her to keep the ring because I didn't care to go sell it or have it hanging around. I bought it for $5k out of my bankroll, she pawned it last week for $800.

I can see reasons for the girl keeping the ring, but it doesn't seem right to me.

Also, its not that simple, as the fact that the guy cheated may itself be a breach of the condition, thus not allowing him to get the ring back.

To me this is irrelevant. If I broke off the engagement or if she did I wouldn't want it back. What the hell are you going to do with the thing? Selling it would involve more pain, and I am probably too damn lazy to get around to doing it. I would rather walk out on a high note and not argue about silly crap like who owns the ring.

If you spent thousands of dollars on a ring, and the girl broke off the engagement, you wouldn't want the ring back to recoup some of that money? Assume that you've followed whatever the rule is and spent 3 months salary on the ring (I think thats what you're supposed to spend, although it could be 6).

I saw it on Judge Judy and she told the girl that the ring is based on the 'promise' of marriage and if you don't marry no ring.

If I remember my 1L crap (which is a big if), engagements used to be considered binding contracts. In most states, if not all, this is no longer the case. The transfer of the ring as consideration for a promise to marry hasn't been enforceable in a long time.

That being said, from a non-legal standpoint, whoever doesn't screw up the engagement should get the ring. (In the case of mutual break-up, guy gets it back.) Here, girl keeps it.
