correct ruling on this one?
 
I played 40€/80€ in a local casino last night, when the following hand came up.

5-way pot.
I'm UTG+1 with A4o and announced 'RAISE' and put in 80€. I didn't notice that UTG haven't acted yet and UTG says that's his turn and he is going to call.
I didn't want to raise A4o after a limper, so I said "I'll fold then", took my money and threw my cards in the middle.
The dealer says "You already acted, your bet is binding!" and I had to put the money in again. I tried to take back my cards (which were in the middle of the table) but the dealer said "you already folded, the cards are dead".

Is this the correct ruling?

Flop came 2-3-5, but that's another story...

There are rooms that will have rule that your bet was binding here (because there was no action equal to or greater than your bet when the action got corrected)

But there is no reason for you not to be given back your cards. They were clearly identifiable as no other cards had been mucked yet.

i believe your bet is binding, and you should get your cards back if they were sitting in the middle of the table. i would imagine house rules may vary.
how did you know the pot would be 5 way if you were utg+1 preflop

"Action out of turn may be binding." Generally this raise should not be required to stay in the pot sicne the intermediate player called, if he had folded I would require the raise to remain.

For places that want to enforce out of turn action what would the OP have to do if he states "raise" out of turn and then the player that hasnt' acted yet wants to raise? Does he then have to make it 3 bets? have to call?

I played in Casino Schenefeld (near Hamburg). There is 10/20, 20/40, 40/80, PL 2000 and NL 500, depends on the weekday. website: http://www.casino-sh.de

The way I know the rules he would have all choices in this case (fold, call, reraise). The way I have seen the rules enforced is that out of turn action is only binding if all players in front of him only call or check depending on the situation.

In many houses, if the out-of-turn action is still valid when it comes your turn, the action must be made.

If you said 'raise' and the raise is still a valid one, you must raise.

If you said 'call' for example, and the player before raised, the 'call' you made is not valid because the action you are calling has changed. At that time, toy could take the money back and reconsider.

You hand, however, should still be live if the cards were retrieveable.

At my cardroom we dont make people honnor their out of turn bets and raises but thats becaues its mostly locals who dont angle shoot. At most cardrooms I think it is pretty standard to make you at least min-raise, and unfortunately, your cards are mucked. Just be careful next time.

I dont know where your cards went on the table, but it would have been nice if the dealer didnt touch them and allowed you to retrieve them if they werent mixed in with other cards.
