If he was holding something like A9, he should have 3 bet the flop with the FD and Str8 draw on the board.

I'd probably call. I doubt he plays a 9 like that on the drawy board. JQ got there but is seems like a bet that doesn't want a call. Could easily be a missed FD 1/3 times.
