View Full Version : Legal Question About This Board and 2 plus 2

Since the neteller folks were arrested under the guise of money laundering when they aided folks in getting money to poker sites, do you think an ATTY for the DOJ could grind his ax some more?

Recently this board has been used as a message center for people to set up peer-to-peer transfers, and much information has been exchanged on how to get money to poker sites, etc.

Since neteller was arrested for basically helping people
get money on sites, couldn't the DOJ stretch it a bit and get 2+2 in trouble also? The DOJ has stretched the envelope and used some creative law making before. RICO statues come to mind, and some of the unheard of ways those regulations have been applied.

This board could be stung, just like neteller:

Federal Agent logs on to board, uses information here or sets up peer-to-peer with other board member, gets cash on a site -- BINGO! 2+2 aided in money laundering.

Just a thought.

I can't see that scenerio but I can may be see them going after 2+2 for advertising or the affiliates..

People can communicate by telephone also. Would the DOJ be justified in going after the telephone company? There is a freedom of speech issue here. Besides, 2p2's primary function is not to facilitate financial transactions.

With this Justice Dept. ANYTHING is possible. Remember, this justice dept. has publicly stated that they are going to go after MAINSTREAM porn producers - Jenna Jameson type porn producers - and attempt to prosecute them. I would not be suprised in the LEAST if they came after ANY website that covers online gaming.

What a country.

Is this site based/owned in the United States???

If this is indeed the case, would say the site, its owners, and their mods are very vulnerable.

We haven't crossed the poker is illegal bridge yet. So far sportsbook are in the crosshairs of the DOJ.

I wonder if Neteller only did poker transactions they would be dealing with the issues they are now.

Totally disagree!

If it were not for poker, online sports wagering would still be going strong and Pinnacle, Mansion, and Bowmans would in all liklihood still be shops for US citizens to play at.

On another side note, poker player always want to make the push that "POKER IS A GAME OF SKILL", while very true, SO IS SPORTSBETTING.

By the way, as we stand right now, ONLINE SPORTSBETTING AND POKER ARE BOTH NOT ILLEGAL ON THE FEDERAL LEVEL IN THE UNITED STATES............AT LEAST UNTIL A BILL SUCH AS HR4777 is put into law.

Keep in mind, the recent legislation is aimed at the offshore sportsbooks/pokersites themselves, as well as the banking institutions in the U.S.

The DOJ would be 'justified' in going after the telephone company if they knowingly allowed it to be used to aid in money laundering, yes. This has nothing to do with freedom of speech nor primary function. 2+2 could not sell marijuana claiming that it was not their primary function, and not expect to have legal problems.

The DOJ arrested two guys, who at this point in time, where shareholders in a company that moved money from point A to point B. I don't see why people who aid in the movement of that same money from point A to point B could also be at risk.

I am just throwing this out there, I wondered if 2+2 considered it's risk when it allows these types of communication to occur on the boards. You know the DOJ likes to go after headlines, could 2+2 be considered a good target?

Except for the commercial side of 2p2 (the links and the book selling) it's a discussion board/information exchange. Suppose people were to do the same as what you are talking about by email? Can't the ISP's monitor email and check for 'illegal' activities? People can talk about the law and it's effect all they want. If you are intimating that 2p2 may somehow be party to a criminal conspiracy by hosting the talk I think that's a very far stretch.

Thanks. I just threw it out there in case it hadn't been given thought.

The Patriot Act (aimed at terrorists) was used to nail a strip club owner, RICO Statues (aimed at organized crime)have been used to get companies that pollute the environment, who knows where these Frist amendment regulations will lead?

Not being ignored at all most likely, but I think he was saying that it had been dicussed by the people who run the board _in private_. Hence the "above my pay grade," statement.
