Pokershare closed my account due to me living in New York. They say i am in one of 11 states that they are banning.

I am surprised NY is one of these states. I am not aware of any special laws in NY.

Anyone have any info or where i can get it?

Not a Crime in NY
Offshore Internet gambling, however, is not a crime in New York, and Gov. George Pataki said the state law did not permit extradition.

"The governor does support the effort to restrict illegal offshore gaming, but he does not have the legal authority to extradite Mr. Dicks," said Pataki spokesperson Jessica Scaperotti.

New York is on the list because of a legal case via a via the 1961 Wire Act. Actually started a lot of the crap down the hill. Internet gaming site said it was off-shore, but had offices in New York, and basically turned out to do all it's business there. Spitzer brought suit alleging it wasn't an off-shore company, and thus doing business illegally. Judge ruled they were violated the 1961 Wire, (although that was partially struck down), and then Spitzer threatened the credit card companies, and that was the end of credit card companies working as payors to and from IG companies. This is the case the gov't uses to allege internet poker is illegal on the face of it. I will post NY law journal article if anyone wants it.

PokerShare had an issue with their original network which had nothing to do with online gambling. The issue was that, as structured then, they were likely selling "securities" in the US which had not been registered with the SEC.

(Their selling of an expectation of a profit from the efforts of others fit the classic definition of a security.)

They may have since revised their scheme. However, if there is still the "securities" issue, then Wall Street and Eliot Spitzer land are not where you want to be pedling violations of the '33 Act.

.... or Mikey the Chimp may be giving them legal advice ...
