Just a thought....Since the law has a carve out for horse wagering, couldn't a poker site just add horse wagering. Would it then be legal for banks to transfer money to them?

wouldn't they have to remove all the illegal gambling, but leave only horse racing?

how about horse races, where the proceeds from a win are poker "freerolls"?

By the same logic, Walgreens can sell recreational drugs online, since they're already selling legal ones, or maybe they could include a nickel-bag free with each purchase of Nyquil.

I was actually referring to the fact that the banks would then be able to transfer the poker sites money as it couldn't be proven that it was for illegal wagering. Plus, the ISP may not be required to block the site.

Its been pointed out before that legal horse racing betting is a regulated thing and tied to one big network. So it's not like this loophole would be open to you setting up shop to take horse bets from your pals, or PartyPoker for that matter. There's "more to it."
