How likely is this to end up in a plea bargain?

Isn't a plea bargain a desirable outcome for us, since it can't expand the scope of the precedent?

Most cases wind up as plea bargains - so it's very likely.

Whether the case goes to trial will have no effect on legal precedent. The publicity about the case is liable to disillusion Americans about the legality of online gambling, however.

There is no way of knowing how likely this is to end in a plea bargain at this stage, without some inside knowledge about the attitude of the defense or the prosecution.

If a court rules that the Wire Act as currently written may be applied to casino games and poker, that would have no effect?

if it makes you feel any better, I doubt any action you took yesterday would have been actioned upon.

honestly, given that the DoJ (app.) wants BoS to return all funds to US customers, I wouldn't jump on the panic bus yet.

course, that's easy for me to say.

well its an odd situation.

a friend withdrew money from BOS yesterday and it was processed without an issue, however the sister site i have my money in only processes withdrawels Tu-Th so yeah i would have been SOL.

i am not overly concerned with not getting paid, i am pretty sure i will actually. still sucks for it to even be an issue.

Are you sure you're shutout? I don't have any BoS accts, but from what i've been reading none of the sister sites are down.

Trial court decisions do not set precedents - only appellate decisions do. It's a mistake to focus too narrowly on the Wire Act, though. The indictment alleges violations of seven different Federal statutes, not just the Wire Act.

No. Every court decision may constitute some precedent and guidance for future cases.

Of course, decisions by appellate court are entitled to greater weight than decisions by trial courts. But trial court decisions often get cited, legitimately, as noteworthy precedent.
